Dispute Management and Litigation |

Robin Millar
Robin has been a full time litigator since 1988 and heads up Young & Partners’ court and dispute resolution team. Considered experienced and solution driven, Robin deals with all types of commercial disputes, advising clients on everything from typical business and contractual disputes to the more complex areas of property, insolvency and intellectual property. There are few areas of litigation Robin has not dealt with, having gained experience and extensive knowledge throughout his notable career, from litigation about tartan, to dealing with ‘dawn raids’. Robin regularly advises on contractual and shareholder disputes, debt recovery, property litigation, personal and corporate insolvency, and intellectual property disputes. Aside from traditional ‘court based’ litigation in the Sheriff Courts and Court of Session, Robin deals with construction disputes, arbitration, construction adjudication and commercial mediation. He has developed relationships with several English legal firms and can therefore assist with cross-border disputes.

Ruth Waters
Ruth is a highly experienced litigator specialising in all areas of commercial dispute resolution, with a particular expertise in construction law. She advises clients in the successful resolution of litigation, conducted both in the Court of Session and the Sheriff Courts. Qualified with a Masters in Construction Law at Strathclyde University, Ruth guides all parties, from developers and consultants to contractors and subcontractors, through the complex drafting and negotiating processes involved in construction and engineering projects. This includes construction contracts, appointments, sub contracts and collateral warranties. Ruth also represents clients in disputed construction contracts and Alternative Dispute Resolution, including adjudication, arbitration and mediation, and is a member of the Adjudication Society. She is a pragmatic business lawyer who focuses on sound practical and commercial advice.

Iain Clark
Iain has a wealth of practical experience gained over more than 15 years of conducting all types of Civil Litigation, particularly private & commercial litigation, in Scotland and internationally. Admitted as a Solicitor Advocate (Civil), he is a highly motivated and proactive specialist litigator, who is able to assist those clients (and other Solicitors and Firms) who require specialist advice in the Court of Session without necessarily incurring the additional expense of Counsel and Edinburgh Agents. He is also a Visiting Lecturer on International Commercial Arbitration at the University of Edinburgh and at the Centre for Energy, Petroleum and Mineral Law Practice (CEPMLP) at the University of Dundee. Iain would be happy to discuss and conduct International Commercial Arbitrations in Scotland (particularly in light of the Arbitration (Scotland) Bill soon to be passed into law by the Scottish Parliament), or further afield.

Stephen Lochrie
Head of Commercial Property. City trained, Stephen heads the largest part of the firm’s portfolio. With a client base UK wide, Stephen is involved in project management as well as more conventional business. His unique approach and ability to structure a deal to best advantage means he is the first port of call for his many successful property clients.

John Cassells
John was appointed as a Partner in April 2008 and has recently formed and heads the new Banking & Securities Unit, as well as continuing to deal with all aspects of commercial property. John also provides expert commercial property advice in relation to complex technical issues, where he combines his wealth of experience and profound knowledge of property law. This, plus his eye for detail, makes him the safest hands in the business.

Neil Wilson
Neil Wilson, formerly of Skene Edwards in Edinburgh, has joined Stephen Lochrie’s commercial property team as a Partner with effect from 1 September. Neil brings the benefit of his experience and abilities advising on a wide range of property matters and projects to clients ranging from corporates and experienced property players to those new to commercial property. Neil’s CV has included accreditation by the Law Society as a specialist in Commercial Leasing, and he teaches property law at Edinburgh University.

Tom Johnston
Having gone from consultant to managing partner in 2 years, Tom combines this role with head of licensing, and contributor to the property department. As he has also failed in his 10 year ambition to retire from litigation, he is the nearest thing the firm has to a general practitioner. Described by Chambers Directory as “an extremely able licensing lawyer, who carries off his personal style with panache.”

Joanna Brynes
Joanna has more than 12 years experience in liquor licensing and gambling matters, planning, insolvency and litigation. She has become a trusted adviser to a wide variety of clients from pub and hotel chains to individual licence holders. Joanna's expertise covers general liquor licensing, betting and gambling, taxi, public entertainment licences and other Civic Government licensing as well as HMRC and SEPA licensing issues. She also advises on other matters such as cinemas, theatres, HMOs, civil marriage and similar. She is a regular attendee at licensing boards throughout Scotland. Joanna speaks at seminars and conferences in both Scotland and England, most recently addressing the national Licensing Conference for Scotland at which Kenny MacAskill was the key note speaker. She also contributes articles to legal and trade publications. Joanna is based in the firm’s Glasgow city centre offices and has clients throughout the UK.
